1. Acceptance of Terms

By installing, downloading, or using Y: AI Photo Retouch & Glow Up, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not install or use the application.

2. Description of the Service

Y: AI Photo Retouch & Glow Up is an artificial intelligence-powered photo editor and conversation-based retouching tool. Features include text-guided retouching, object removal (Magic Eraser), artistic styling, photo enhancement, background changes, outfit simulation, and creative portraits.

3. Acceptable Use and Content Standards

You agree not to use the application to process, generate, or distribute any content that:

• Is illegal, sexually explicit, pornographic, or depicts non-consensual sexual content.
• Promotes violence, terrorism, hate speech, defamation, or discrimination against any individual or group.
• Infringes upon third-party copyrights, trademarks, publicity rights, or intellectual property rights.
• Generates non-consensual deepfakes or impersonates another individual with malicious or deceptive intent.
• Attempts to circumvent, bypass, or reverse engineer security filters or authentication systems.

Violation of these standards will result in immediate termination of service access and, where appropriate, reporting to relevant law enforcement authorities.

4. User Content and Intellectual Property

• Your Original Photos: You retain full ownership and intellectual property rights in the photos and prompts you submit.
• Generated Outputs: To the maximum extent permitted by applicable law, you own the transformed and generated images created through your prompts and photos.
• Service License: You grant us a non-exclusive, worldwide, royalty-free license solely to process and transmit your photos and prompts as needed to perform the requested editing transformations.

5. Google Play Subscriptions and Payments

Certain advanced features and high-definition exports require a Premium Subscription:

• Payment Processing: All in-app purchases and subscriptions are processed securely by Google Play via your Google Account.
• Billing Cycle & Auto-Renewal: Subscriptions are billed on a recurring basis (e.g. weekly or yearly). Your subscription automatically renews unless auto-renew is cancelled at least 24 hours before the end of the current billing cycle.
• Free Trials: If offered, any unused portion of a free trial period is forfeited when you purchase a subscription. At the end of the trial period, your Google Account will be charged the standard subscription price unless cancelled prior to trial expiration.
• Cancellation: You can manage or cancel your subscription at any time via Google Play:
  1. Open the Google Play Store app on your Android device.
  2. Tap your profile icon in the top right corner.
  3. Tap Payments & subscriptions → Subscriptions.
  4. Select Y: AI Photo Retouch & Glow Up and tap Cancel subscription.
• Refunds: Refund requests are governed by Google Play Store Refund Policies and must be submitted through your Google Play order history.

6. Content Reporting Mechanism

In compliance with Google Play's Generative AI policy, users have direct access to an in-app reporting tool (via the flag icon ⚑ or the message action menu) to flag any offensive, infringing, or inappropriate generated content. We actively monitor and review reports to maintain safe and respectful outputs.

7. Disclaimer of Warranties

THE APPLICATION AND ALL AI SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WHILE OUR AI MODELS AIM FOR ACCURATE AND HIGH-QUALITY RETOUCHING, RESULTS MAY OCCASIONALLY VARY DUE TO THE NATURE OF GENERATIVE MACHINE LEARNING.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INDIVIDUAL ENTREPRENEUR DMYTRO MISHCHENKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE.
